ZOOM Care Limited (trading as, and referred to herein as, “ZOOM Pharmacy”) and/or ZOOM Health Limited ( shareholder of, and service provider to, ZOOM Pharmacy and owner of the website at https://zoompharmacy.co.nz/ such website referred to herein as our “Website”) provide website features and products and services to you via our Website or any alternative means. Our provision of website features and products and services to you (via our Website or any alternative means), your use of the Website, your use of any ZOOM Pharmacy products or services provided to you by us, and any interactions or communications between you and ZOOM (whether via our Website or any alternative means) is referred to collectively in this privacy policy as the “ZOOM Pharmacy Service”.
Your privacy is important to each of ZOOM Health Limited and ZOOM Pharmacy (ZOOM Health Limited and ZOOM Pharmacy referred to together in this privacy policy as “ZOOM“, “we”, “our” or “us”) and we comply with:
- the New Zealand Privacy Act 2020 (the “Act“) and the Act’s Privacy Principles when dealing with personal information; and
- the principles of the Health Information Privacy Code 2020 (the “Code“), the HISO 10064:2017 Health Information Governance Guidelines and the Health (Retention of Health Information) Regulations 1996 when dealing with health information.
This document is our privacy policy and it sets out how we collect, use, disclose and protect your personal information and health information. Please read the following carefully to understand our practices regarding your personal information and health information and how we will treat it. By continuing to use any part of the ZOOM Pharmacy Service (including but not limited to your use of our Website, your purchase of products from us and/or engaging us to provide services to you), you are accepting and consenting to the practices described in this policy.

What is your personal information
When used in this privacy policy, the term “personal information” has the meaning given to it in the Act. In general terms, it is any information that can be used to personally identify you. This may include your name, telephone number, email address, mailing or street address and profession or occupation. If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.
What personal information do we collect
We may collect your name, telephone number, email address, mailing or street address, age or date of birth, profession, occupation or job title and any additional information relating to you that you provide to us directly either in person, in writing, through our Website or through any other means as part of the ZOOM Pharmacy Service or indirectly through your use of our Website or other online presence.
We may also collect some information that is not personal information because it does not identify you or anyone else. For example, we may collect anonymous answers to surveys or aggregated information about how users use our Website.
Who do we collect your personal information from
We collect personal information about you from:
- you, when you provide that personal information to us, including via our Website or through any other means as part of the ZOOM Pharmacy Service, our IT systems or data centres used in the operation of our business and/or the provision of our Website
- third parties (including but not limited to any holder of public records) where you have authorised this or the information is publicly available.
If possible, we will collect personal information from you directly.
If you choose not to provide us with the personal information that we request or require, then we may not be able to offer the ZOOM Pharmacy Service to you.
Why we collect your personal information & how we use & disclose it
We may collect, hold, use and disclose your personal information:
- to verify your identity
- to confirm and arrange orders placed by you
- to support payment obligations in respect of orders
- to provide any part of the ZOOM Pharmacy Service to you upon request
- to assist you in your use of the ZOOM Pharmacy Service (including but not limited to your use of the products and/or services provided to you by us upon request)
- to contact you for marketing purposes including but not limited to presenting you with information about suitable offers and promotions of products or services from us that might interest you
- to better understand your preferences so that we can improve the ZOOM Pharmacy Service and our products and services provided (or to be provided) to you
- to present you with survey requests and to obtain feedback in respect of the ZOOM Pharmacy Service (including but not limited to any products and/or services provided to you by us
- to respond to communications from you
- to conduct research and statistical analysis (on an anonymised basis)
- to protect and/or enforce our legal rights and interests, including defending any claim
- for any other purpose authorised by you or the Act.
Who we disclose your personal information to
We may disclose your personal information (for the purposes described above) to:
- our employees
- another entity within our group
- any business that supports our activities, including any person that hosts or maintains any underlying IT system or data centre that we use in the operation of our business, to provide the ZOOM Pharmacy Service (including but not limited to the provision of products and/or services and/or the provision of our Website)
- other third parties (for anonymised statistical information)
- a person who can require us to supply your personal information (e.g. a regulatory authority)
- any other person authorised by the Act or another law (e.g. a law enforcement agency)
- any other person authorised by you.
Protecting your personal information
We take reasonable steps to ensure your personal information is:
- protected against loss, damage, misuse and unauthorised access. We restrict access to personal information to those individuals who need access to this information in order to assist us in performing our activities; and
- accurate, up to date, complete, relevant and not misleading.
Accessing and correcting your personal information
Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.
If you want to exercise either of the above rights please contact ZOOM’s Privacy Officer at the email address set out at the end of this privacy policy. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).
We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.
Electronic Communications
Unless you request that we do not to use your personal information for marketing purposes, you acknowledge and agree that by providing us with your personal information we and our third party business partners may use that information to send you electronic messages (including but not limited to push notifications, text messages and emails) for the purposes set out in this policy (including for marketing purposes).
You have the right to ask us not to collect, use or disclose your personal information for marketing purposes. You may exercise this right by contacting the Privacy Officer at the email address set out below or by unsubscribing to our marketing emails (using the link included within those emails).
Health Information

What is your health information
When used in this privacy policy, the term “health information” has the meaning given to it in the Code. In general terms, it is any health information about an identifiable individual. This includes information such as your medical history, any disabilities, any health or disability services provided to you, information you have provided in connection with the donation of any body part or bodily substance or derived from testing or examination of any body part or bodily substance or information about you collected in the course of the provision of any health or disability service to you.
What health information do we collect
We will be provided with details of your prescription (including NHI number, medicine name, dose, frequency, and duration) by you, your prescriber or a pharmacy in order to provide the ZOOM Pharmacy Service.
In some cases, like when purchasing medicines (or other products), requesting services or registering for the ZOOM Pharmacy Service, we may need to collect applicable health information held on your behalf by Te Whatu Ora – Health New Zealand (referred to hereafter as “Health NZ”) to check if a requested medicine or service is suitable for you.
The collection of such health information is necessary for our provision of, and your use of, the ZOOM Pharmacy Service. We will use this health information appropriately and comply with all laws applicable to us in respect of such information.
By clicking “I have read and agree”, checking a related box to signify your acceptance, using any other acceptance protocol presented through the ZOOM Pharmacy Service or otherwise affirmatively accepting the ZOOM Pharmacy Service terms and conditions you acknowledge that you have read, accepted, and agreed to be bound by the terms of this privacy policy (which is incorporated by reference into the ZOOM Pharmacy Service terms and conditions).
Accordingly, if you choose not to provide (or authorise the provision of) the required health information we will not be able to provide, and you will not be able to use, the ZOOM Pharmacy Service.
Who do we collect your health information from
We do not gather health information about you without your knowledge.
As noted above, we collect details of your prescription (including NHI number, medicine name, dose, frequency and duration) from you, your prescriber or a pharmacy and we may need to collect further applicable health information about you from Health NZ to check is a requested medicine or service is suitable for you.
How we use your health information
We will use your health information to enable fulfilment of your prescription by ZOOM Pharmacy and our provision of the ZOOM Pharmacy Service to you.
A ZOOM Pharmacy pharmacist may also use your health information (and/or personal information) in order to contact the prescriber and/or you if there is a potential problem with the prescription or adherence.
Disclosing your health information
We will not sell, lease, or give your health information to any third party without your consent or as otherwise permitted or required pursuant to the Code.
ZOOM may share anonymous demographic data but all identifying details will be removed.
Protecting your health information
Security and data/patient anonymity are core features of the ZOOM Pharmacy Service.
The ZOOM Pharmacy database holds prescriber, pharmacy and patient information in a secure and anonymous manner using unique identification numbers. The use of unique identification numbers means that individual patient health information held by ZOOM can only be used to identify a specific patient by that patient’s prescriber.
Accessing and correcting your health information
You may access any health information we hold and correct any mistakes at any time by contacting ZOOM’s Privacy Officer at the email address set out at the end of this privacy policy. Your email should provide evidence of who you are and set out the details of your request (e.g. the health information, or the correction, that you are requesting). You can also update your health information at any time through your prescriber or pharmacy.
General
Internet use
While we take reasonable steps to maintain secure internet connections, if you provide us with personal information or health information over the internet, the provision of that information is at your own risk.
If you follow a link on our Website to another site, the owner of that site will have its own privacy policy relating to your personal information (and/or health information if applicable). We suggest you review that site’s privacy policy before you provide personal information and/or health information.
Public Records
We may from time to time, in connection with our provision of the ZOOM Pharmacy Service, require access to “public records” (as that term is defined in the Public Records Act 2005 (the “PRA”)) relating to you and if, as a result of such access or for any other reason, we are deemed to be a “public office” (as that term is defined in the PRA) for the purposes of the PRA, then we shall comply with the obligations imposed upon a public office under the PRA. For the avoidance of doubt, unless and until we are deemed to be a public office under the PRA, we are not required to comply with the obligations of a public office under the PRA (in relation to public records or otherwise).
Changes to this policy
We may need to update this privacy policy from time to time to reflect changes in our legal obligations, practices and services. The current up-to-date version of this policy is available on our Website and we may change this privacy policy by uploading a revised policy onto our Website. Any changes will apply from the date that we upload the revised policy to our Website – accordingly we recommend that you check the current privacy policy on our Website from time to time to take note of any changes we make, as they are binding on you.
